As of April 2024, Senate cryptocurrency legislation faces resistance over conflict-of-interest provisions

WASHINGTON, / RankWire.AI / – On Monday, ethics watchdog organizations and legal specialists urged Congress to include strict anti-corruption measures in upcoming cryptocurrency laws, warning that lawmakers must address the crypto conflict of interest loopholes or consider abandoning the CLARITY Act altogether. In a joint statement, nonpartisan advocacy group Democracy Defenders Action and civil society organization Transparency International U.S. criticized the ethics provisions in the Digital Asset Market Clarity Act. They contended that the current legal framework fails to safeguard the integrity of the digital asset marketplace, American consumers, and the broader economy from officials’ potential self-dealing actions.

Experts from both oversight groups observed that the ethics language introduced in the Senate draft was narrowly tailored and included significant statutory exemptions. The advocacy organizations stated that the draft law effectively grandfathered in existing cryptocurrency holdings and financial arrangements without establishing strong enforcement mechanisms. They argued that the legislative language essentially provides immunity for pre-existing commercial ventures from federal oversight. To promote meaningful reform, watchdogs called for a comprehensive ban preventing all covered government officials from holding direct financial interests, engaging in digital asset trading, or benefiting from existing licensing and profit-sharing agreements.

The coalition advocating for reform outlined essential policy measures to stop public officials from leveraging federal digital asset regulations for private financial benefits. They proposed ethics standards requiring officials and their immediate family members—including spouses and dependent children—to divest from all digital asset holdings outside diversified registered investment funds. The groups also emphasized the need for strict rules to prevent adult children of public officials from using family ties or proximity to power to advance commercial crypto ventures. The organizations stressed that full financial disclosure must cover all digital asset transactions—acquisitions, sales, or transfers—regardless of compensation received.

Ethics Advocates Call for a Complete Ban on Official Crypto Holdings

Regarding enforcement, oversight groups emphasized that ethics regulations must be backed by independent administrative authority capable of functioning beyond individual presidential terms. They urged Congress to grant investigative powers to the Attorney General under an extended statute of limitations, allowing private entities and state attorneys general to take legal action against misconduct by officials. Virginia Canter, chief counsel and director of ethics and anti-corruption at Democracy Defenders Action, stated that ethics legislation lacking independent enforcement mechanisms effectively enable corruption, urging Congress to implement a total ban on digital asset holdings for officials and their families.

Analysts and policy experts noted that the broader legislative debate around the CLARITY Act centers on establishing clear regulatory jurisdiction over the digital asset sector. The legislation aims to clarify the roles of federal market regulators and move away from enforcement-heavy policies. However, ethics advocates stress that public trust depends on maintaining strict boundaries between regulatory authority and private financial interests. Scott Greytak, deputy executive director at Transparency International U.S., said that the public expects officials to choose between overseeing the industry or profiting from it, emphasizing that lawmakers must close the crypto conflict of interest loopholes or discard the CLARITY Act to uphold government integrity.

Calls for a Complete Ban on Direct Digital Asset Ownership by Officials

As the Senate reviews the bill language, increasing pressure mounts from ethics organizations for Congress to resolve disputes over conflict-of-interest safeguards. Experts on oversight argue that granting exemptions for pre-existing commercial ties sets a dangerous precedent for federal ethics enforcement, especially within emerging financial sectors. Representatives from both advocacy groups reaffirmed that eliminating current exemptions should be the minimum requirement to rebuild public confidence in federal market oversight.

The future progress of the CLARITY Act depends on whether committee negotiators include binding ethics provisions before the bill reaches a final floor vote. Congressional aides reported ongoing bipartisan discussions regarding potential amendments to enforce mechanisms. Ethics advocates warned that passing the legislation without comprehensive ethics restrictions would undermine regulatory credibility and perpetuate conflicts of interest within the federal government.
